Sample Professional Services Contract for Folklife Fieldwork

Be it known that on this date, DATE, FIELDWORKER NAME, hereinafter referred to as Fieldworker, and the AGENCY NAME, referred to as ACRONYM, do enter into the following contract for services regarding the PROJECT NAME.

1.

Fieldworker agrees to:

A. Document up to NUMBER individual(s) who maintain traditional folk skills and/or knowledge and who reside in the REGION/GENRE. Each interview must be pre-approved by SUPERVISING FOLKLORIST, the AGENCY/PROJECT DIRECTOR who is coordinating the fieldwork.

Priority will be given to individuals willing to participate in the FESTIVAL/EXHIBIT/PROJECT in LOCATION, DATE. The fieldworker will interview the individual(s), documenting them with audio tape and photography.

B. Submit the following on each individual documented:

1. Louisiana Folklife Survey forms on each individual interviewed with their signature.

2. Audio tape(s) of the interview, labeled with the following: date of interview, name of Interviewer, name of interviewee, topic of interview, place of interview.

3. Color slides or black and white photographs of the person interviewed and contextual information such as the person's home, the craft process, musical instruments, etc.

a. Color slides must be labeled with the subject and photographer. Fieldworker should use the processing mailer provided to send the film to be developed, have it returned to the fieldworker, and then label the slides.

b. Black and white photographs should be sent to PERSON for processing. A contact sheet will be returned to the fieldworker who will fill out a photolog.

4. Field report interpreting the data which will include a plan for possible presentation of the tradition at the festival. The plan will include physical needs for the presentation such as water, electricity, supplies, equipment, space, safety requirements, etc.

5. Biography(ies) of those interviewed approximately 50-100 words in length suitable for possible publication in the festival program.

6. The AGENCY will provide supplies to PERSON who will distribute them to the fieldworker. If the situation arises where the fieldworker needs additional supplies while conducting fieldwork, the following supplies should be used:

a. Tapes will be archival quality, high-bias, 60-minute tapes.

b. Slide film should be Kodachrome.

c. Black and white film, any professional film is acceptable.

C. The AGENCY will provide and assume responsibility for the following equipment: audio recorder and assessories, video recorder, etc. The FIELDWORKER will provide and assume responsibility for the following equipment: camera and assessories, etc.

D. Submit the materials described in Section B by DATE to PERSON. All used and unused film, processing mailers, and audio tape must be returned by this date.

Compensation for these services will be $000.00 per interview completed, for up to NUMBER interviews, paid by AGENCY to the fieldworker after submission of reports, biography(ies), tapes, and film. Travel and other field expenses will be paid at the rate of $.00 per mile up to a total of $00.00 upon submission of a reimbursement form. Fieldworker will not be reimbursed for fieldwork that does not result in submission of all materials described in number 2. Payment of interview fees may be delayed until receipt of grant funds.

Contract period will be from DATE to DATE. Any changes in the scope of contracted services must be submitted in writing and agreed to by all parties.

4.

Fieldworker will be held harmless of any liability arising from service pursuant to this contract. The AGENCY and the PROJECT/EVENT shall be held harmless of any liability arising from the service pursuant to this contract.
